Our commitment to fair and transparent business practice is reflected in the Terms and Conditions of Use and our Privacy Policy, collectively referred to as the Terms of Use. By using this website you accept the Terms of Use; if you disagree with any part of them, you may not use this website.

3. Intellectual Property Rights
All intellectual property rights associated with this website, including but not limited to its content, structure, functionality, code and branding, are owned by Clear.
4. Allowed Usage
You may view, print or download (for caching purposes only) pages and elements of this website, provided that:
- it is for personal, non-commercial use and,
- none of the information, content, structure, functionality, code, branding or applicable notices are removed, altered, adapted or obscured, unless you have specific written consent from Clear.
Press releases from the site may be reproduced for editorial purposes in daily newspapers, general circulation news magazines, trade publications and broadcast media; however written permission is required for any other variation from the Allowed Usage.
5. Calculation of emissions
Clear aims to provide the most representative calculation of emissions available, audited annually by the Quality Assurance Standard (QAS). The factors used in these calculations can and do change over time. Clear will therefore not accept any altered liability due to subsequent changes in Clear’s method of calculation after the offset transaction date. Clear is also not responsible for the accuracy of the information that is entered into our calculation engines, on which our emissions calculation is based.
6. Carbon offsets
Clear undertakes to purchase and retire sufficient emissions reduction certificates to offset the stated amount of emissions through an official registry. The purchase and retirement of these certificates are voluntary and cannot be used for compliance purposes. The timing of each retirement is optimised by Clear’s trading strategy, which utilises financial risk management techniques to balance efficiency and economy for Clear’s customers. However the interval between offset purchase and retirement of the corresponding certificates shall not in any case exceed fifteen months as mandated by the QAS, who audit annually to ensure compliance.
Clear will refund any purchase on the site provided that we are notified by 5pm on the 3rd day following the purchase in the time zone it was made. Clear will only issue refunds beyond this time frame at our own discretion and in exceptional circumstances.
Anyone purchasing carbon offsets from Clear give their implicit to receive an invitation by email to review their order after it is made.
7. Restriction of access
Some areas of the Clear site require user registration and secure login using a username and password. These restrictions may vary over time. Clear does not accept responsibility for the security of user registration details, or for the activities that occur under them, so please take care to keep your password confidential.
Restricted access may be disabled for any user who we believe to have breached the Terms of Use.
8. Publicity
Any publicity relating to the Clear website or its Terms of Use will be subject to a separate agreement, which must be agreed to in advance. Clear reserves the right to mention corporate clients in published client lists.
9. Limitations of liability
The Terms of Use are the only part of this site intended to form any binding contract. In particular, notes on products and services are stated on an ‘invitation to treat’ basis and are ‘subject to availability’.
Whilst Clear endeavours to keep the information on this site accurate and up-to-date, it does not make any warranty as to its completeness or accuracy; nor do we guarantee its availability. Clear will not be liable for any direct, indirect or consequential loss or damage arising under these Terms of Use or in connection with our website, including any loss of business, profit, contracts, data, income, revenue, goodwill, reputation or anticipated savings. If you are dissatisfied with any portion of this site, your sole and exclusive remedy is to discontinue using it.
The site may include links to third party websites; these links are for your convenience only, and these sites are party to separate agreements. Clear therefore specifically disclaims responsibility arising from use of these sites. If you access such websites or establish a link to such websites, you do so at your own risk and without our permission.
10. Changes to the Terms and Conditions of Use
Clear may update these Terms and Conditions of Use from time-to-time. We therefore recommend that you check to see if they have changed periodically.
11. Legal Jurisdiction
Any dispute arising from the use of this website shall be subject to the exclusive jurisdiction of the courts of England.
